APPLIES TO ALL ARF DATA HELD BY PRI
By accepting the 2005 [version of] the Area Resource File (ARF) system, the recipient agrees to the following terms and conditions.
TITLE OF AGREEMENT: Data Use License Agreement for the use of the Area Resource File (ARF) system issued by the National Center for Health Workforce Analysis (NCHWA), Bureau of Health Professions, Health Resources and Services Administration.
PURPOSE OF AGREEMENT: The Area Resource File (ARF) system is a computer-based health information system with broad analytical capabilities. It utilizes health personnel and related secondary data that are available on a compatible basis for all counties in the U.S. The purpose of this Agreement is to provide the recipient a copy of the ARF CD-ROM containing the DATA File and Technical and User Documentation, subject to the following terms and conditions:
1. The recipient will not distribute copies of the ARF or make the DATA available to a third party. The recipient's Authorized Users may transmit to a third party colleague in hard copy or electronically, minimal amounts of the ARF data for scholarly, educational, or scientific research or professional use but in no case for re-sale. In addition, Authorized Users have the right to use, with appropriate credit, figures, tables and brief excerpts derived from the ARF data in the Authorized User's own scientific, scholarly and educational works. (Please note that PRI has received permission to allow the data to be used by faculty, staff, and students at Penn State. Please do not make copies of the data in its entirety. The data is also available online for variable extraction to Penn State users only (restricted port access).
2. The recipient will not resell the ARF, or portions of the DATA.
3. The ARF data, although not protected by copyright laws, is considered proprietary by NCHWA.
4. Information from the ARF should be appropriately attributed through the use of the following citation: Area Resource File (ARF). February 2005. US Department of Health and Human Services, Health Resources and Services Administration, Bureau of Health Professions, Rockville, MD.
5. NCHWA believes the data to be accurate, but will make no warranties or representation, express or implied, including, but not limited to, the implied warranty of merchantability and fitness to a particular purpose. In no event shall NCHWA have liability for any damage. Under no circumstances shall NCHWA be liable for incidental, consequential, special or exemplary damages of any kind.
6. Whenever NCHWA has knowledge or reason to believe that the recipient has failed to observe the terms and conditions of this Agreement, NCHWA will notify the recipient of the concerns. The recipient is required to provide adequate documentation or information to establish to NCHWA's satisfaction that the concerns are without merit, or to remedy the situation within 30 days or within a reasonable timeframe agreed to by both parties.
7. This Agreement supersedes all prior agreements and understandings of any nature whatsoever, oral or written, and constitutes the entire understanding between the parties hereto.
8. This Agreement may be modified or terminated at any time by mutual consent of the parties.
9. This Agreement is in no relation to any other Agreement between NCHWA and the recipient.
